For most county citizens, the answer is VDOT - the Virginia Department of Transportation. In fact, VDOT is responsible for maintenance of all public streets, roads, and highways in the county (in contrast to cities, where the city governments are responsible for maintenance). The exceptions to this general rule are the various private streets, for example in townhouse or condominium developments, where property owners' associations have maintenance responsibility. If you are thinking about renting out your house, an accessory structure, or one or more rooms in your house on a short-term basis (i.e., fewer than 90 days), here are some things you need to know:
- In York County, short-term rentals (STRs) fall into the category of either tourist homes or bed and breakfast inns (B&Bs). The distinction between the two is that in a B&B, breakfast is provided in addition to overnight accommodations, and the property owner is required to live on the premises or in adjacent premises.
- Tourist homes and B&Bs are permitted as a matter of right in the LB (Limited Business) and GB (General Business) zoning districts. In residential zoning districts – RC, RR, R33, R20, R13, and RMF – they are permitted only upon the issuance of a Special Use Permit by the Board of Supervisors. Special Use Permits are a special privilege granted by the Board under a specific set of circumstances and conditions, and each application and situation is unique. The Special Use Permit process typically takes between two and three months. It requires two advertised public hearings, and a non-refundable application fee of $450.
- STRs in residential districts must have the appearance of a single-family detached home and normal accessory residential structures.
- All parking must be accommodated on the property. On-street parking is prohibited.
- One freestanding, non-illuminated sign, not exceeding four (4) square feet in area, may be permitted to identify the STR.
- The maximum number of guests will be determined by the Board of Supervisors based on the density and character of the area and the size and characteristics of the proposed site.
- STRs are subject to the state sales tax as well as the 5% County transient occupancy tax and $2.00 per night room tax. The proprietor of any such establishment is required to obtain a County business license, establish a County transient occupancy tax account, and file with the Virginia Department of Taxation for a Virginia State Sales Tax account. No, you are not required to acquire a license for cats, and cats are allowed to roam free without being tethered. However, they do need to be vaccinated for rabies.
All dogs and cats are required by state law to be vaccinated for rabies at 4 months of age.

Report loss pet to Animal Services at 757-890-3601. Search your immediate neighborhood. Call your local animal shelter to see if your pet was picked-up and to report the loss if your pet should happen to be brought in on a later date. You can call the Heritage Humane Society at 757-221-0150 (typically animals picked up in the Northern End of York County) and the Peninsula Regional Animal Shelter at 757-933-8900 (typically animals picked up in the Southern End of York County).
Pets without identification can look alike so, visit the animal shelter and look at the animals not only in the impound area but, also the animals in the injured, sick, and quarantine areas. If you find your pet, please advise the local shelter and Animal Services, so the lost pet can be cleared off their list of lost animals.

Our Animal Control Officers do not respond to calls to remove crawling critters such as spiders, mice, lizards, or flying bugs like wasps, hornets, bees, or any other buzzing insects from your property. Animal Control
Animal Services will not trap nuisance wildlife that is on your property or that is simply passing through your yard. They will only respond to wildlife that is an immediate threat to personal safety, because it is in the main living space of your home. A nuisance animal is an animal that habitually destroys property. Some animals are exempt from being declared a nuisance, such as all birds of prey (ospreys, eagles, falcons, hawks, etc.), deer, and any animal or reptile protected by the state and/or federal government.
Should you have a reoccurring problem with nuisance wildlife, you may contact the Wildlife Conflict Hotline at 1-855-571-9003 in regards to deterring the species of animal that is concerning you. You may also want to check out the link below from VDWR (Va. Department of Wildlife Resources). It lists many different types of animals and suggests ways to try to keep those animals from continuing to visit your yard. You may also contact a local wildlife removal company to trap the species at a cost to you. A quick search on the internet will give you a list of companies to choose from.
It is important to note that Animal Services also does not collect newborn or orphaned wildlife. You may contact Tidewater Wildlife Rescue for emergencies at 757-255-8710 or the Wildlife Response Hotline at 757-543-7000.

Animal Control
According to the VDWR, more often than not, handling injured, sick, or orphaned wildlife can do more harm than good. Although our intentions are well-meaning, human interaction with wildlife should always be kept to a minimum. Humans often misinterpret normal wildlife behavior as abnormal and may unnecessarily disturb and stress wild animals by attempting to catch them.
Often, particularly in spring, concerned people pick up animals that they think are orphaned. More than 75 percent of such orphans “rescued” every spring should have been left alone. Most wild animals are dedicated parents and will not abandon their young, but they do leave them alone for long periods of time while looking for food. Additionally, many behaviors that people may view as abnormal actually are not in wildlife, and people may do much more harm than good by attempting to catch them for rehabilitation.
Do not attempt to rescue skunks or bats. These are high-risk animals that are potentially harmful to your health. Never attempt to capture an adult sick or injured mammal. If they are frightened and/or in pain and see you as a threat, they can be quite dangerous and can cause a severe bite.

If a wild animal has been injured or truly orphaned, please locate a licensed wildlife rehabilitator by calling the Virginia Department of Wildlife Resources at their toll-free wildlife conflict hotline at 1-855-571-9003, 8:00 AM-4:30 PM, Monday through Friday, or visit the licensed wildlife rehabilitator section of their website.

Animal Control
"Rabies is a deadly disease caused by a virus that attacks the nervous system. It kills almost any mammal or human that gets sick from it." (Virginia Department of Health)
The Rabies virus lives in the saliva and is spread when the infected saliva gets into a wound. Only mammals get rabies. Rabies can be prevented by getting the proper vaccinations from you local veterinarian on a regular basis. Keep records of your pet’s vaccinations for future reference.
Only mammals get rabies: bird, fish, reptiles, and amphibians do not. Skunks, bats, foxes, raccoons, dogs, cats and some farm animals are most likely to get rabies. Rabbits, squirrels, rats and mice, and pets like gerbils and hamsters seldom get it.
Rabies can be prevented in cats, dogs, and some livestock with a rabies vaccination. For most wild and exotic animals, there are no rabies vaccines available that have been shown to protect them. A vaccine is available for ferrets, but because not enough is know about how rabies affects them, even vaccinated ferrets may still have to be killed and tested if they bite someone or get exposed to a rabid animal.
Because of improved rabies vaccination programs for pets and better treatment for people who are bitten, rabies cases among humans in this country are rare. The best way to prevent the spread of rabies to humans is by keeping pets properly vaccinated.
What to Do
If your pet is bitten, contact the local health or animal control authorities. To limit the possibility of exposure, keep your pets on your property. Do not leave garbage out that may attract wild infected animals to your property. A rabid animal sometimes acts tame. Do not keep wild animals as pets. If you see an animal acting strangely, report it to your local animal control. Do not go near it yourself!
If your pet has bitten someone, tell the person who was bitten to see a doctor immediately. Domestic animals will be confined for a period of 10 days for observation/quarantine. Report the bite to the Animal Control Services at 757-890-3601 and to the local health department as well. In Williamsburg, this number is 757-603-4277. The number for all other areas on the Virginia lower Peninsula is 757-594-7340.
If you have been bitten, do not panic but do not ignore it. Wash the wound thoroughly with soap and plenty of water. Get medical attention as soon as you can. If you can, identify the animal before it runs away, then call the local animal control. If it is a wild animal that must be killed, do not damage the head. The brain is used to test for the rabies virus.

The Division of Building Safety office hours are from 8:00 a.m. to 4:30 p.m., Monday through Friday, excluding holidays.

Building Safety
The Virginia Uniform Statewide Building Code (VUSBC), established criterias for building permits. In addition to permits for new construction, permits are needed for renovation, demolition, plumbing, gas, mechanical, electrical, fire protection and asbestos removal. Section 108 of the VUSBC specifies when a application and building permits are required.
VUSBC Section 110.5 states, "A permit shall be considered authority to proceed with construction in accordance with this Code, the approved construction documents, the permit application and any approved amendments or modifications. The permit shall not be construed to otherwise authorize the omission or amendment of any provision of this Code.

Building Safety
Building permits are required for most construction activity. VUSBC Section 108 requires a permit to be issued by the building code official when:
- Above and in-ground swimming pools.
- Changing the use of a building either within the same use group or to a different use group when the new use requires greater degrees of structural strength, fire protection, exit facilities or sanitary provisions. Constructing, enlarging, altering, repairing, or demolishing a building or structure. Fences associated with swimming pools.
- Installing or altering any equipment which is regulated by this code.
- Removing any asbestos containing material. When erecting a tent greater than 900 square feet in size and intended to be used by fifty or more persons.
- When installing or extending any plumbing, electrical, or mechanical systems.
- When moving a lot line that increases the hazard to or decreases the level of safety of an existing structure in comparison to the building code under which the structure was built.

Building Safety
All building plans are reviewed by the Division of Building Safety subsequent to Planning & Development Services and Stormwater reviewing and approving their respective requirements.
A building permit can be issued when all the reviews have been completed, approved and all applicable fees been paid. Many projects will also require reviews by Public Works Utilities Operations and the Department of Fire and Life Safety. The reviews ensure that the project can be built within the code requirements and will reduce field inspection delays.
The Department of Fire and Life Safety reviews plans with the Division of Building Safety for fire alarms, commercial kitchen range hoods and sprinkler systems. Although building plans are jointly reviewed, the Department of Fire and Life Safety does not issue building permits. All construction plans should be submitted to the Division of Building Safety who in turn will forward them to Fire and Life Safety for review. Fire and Life Safety can be at (757) 890-3600.
In many cases, the above reviews may not be required or may be completed in a shorter time frame. The larger the projects the greater the impact and more reviews and approvals are required. It is always best to plan ahead for any size projects.
Commercial projects require an approved site plan before building permits can be issued. Building plans can be submitted for review before site plan approval and it is recommended that they are submitted simultaneously.
The plan review also includes the Americans with Disabilities Act (ADA) requirements. Before a permit is issued all local and Hampton Roads utility connection fees must be paid. Standard fees may be obtained and can be paid through either the Division of Utility Billing in our Finance Department or the Utilities Operations Division of Public Works.

Building Safety
You do not need a permit for ordinary repairs and specific exceptions to the code. Ordinary repairs and Exceptions are:
- Installation of cabinets in all occupancies.
- Installation or replacement or floor finishes in all occupancies. Light fixtures and ceiling fans, within the dwelling unit in occupancies of Use Group R-2 and in occupancies of Use Groups R-3, R-4 and R-5.
- Painting any portion of a structure, repair of plaster, interior tile and other wall coverings in all occupancies.
- Replacement of 100 square foot or less of roof decking in Use Group R-3, R-4 or R-5 unless the decking to be replaced was required at time of original construction to be fire-retardant-treated or protected in some other way to form a fire-rated wall termination.
- Replacement of mechanical appliances provided such equipment is not fueled by gas or oil, within the dwelling unit in occupancies of Use Group R-2 where serving a single family dwelling and in Use Groups R-3, R-4 and R-5.
- Replacement of plumbing equipment without alteration of the water supply and distribution system, sanitary drainage systems or vent systems.
- Replacement of windows and doors of similar operation and opening dimension that do not require changes to existing framed opening.
Ordinary repairs shall not include the cutting away of any wall, partition or portion thereof, the removal or cutting of any structural beam or load bearing support, change of any required means of egress, or rearrangement of parts of a structure affecting the egress requirements; nor shall ordinary repairs include addition to, alteration of, replacement or relocation of any standpipe, water supply, sewer, drainage, drain leader, gas or oil, soil, waste, vent or similar piping, electric wiring or mechanical or other work affecting public health or general safety.
One story detached accessory structures not located in a designated flood zone and used as tool and storage shed, playhouse or similar uses provided the floor area does not exceed 256 square feet in size, the building eave height is 10 feet or less and the maximum height from the finished floor level to grade does not exceed 18 inches.
When a permit is required, it must be obtained before work begins. Only in emergency situations will work be allowed to start before obtaining a permit. These situations would include needs for emergency heat, hot water or replacement safety glass. Permits, notification and inspections must be obtained the next working day.

Building Safety
Virginia Residential Code
R609.4 Garage doors.
Garage doors shall be tested in accordance with either ASTM E330 or ANSI/DASMA 108, and shall meet the pass/fail criteria of ANSI/DASMA 108.
R609.4.1 Garage door labeling.
Garage doors shall be labeled with a permanent label affixed to the garage door by the manufacturer. The label shall identify the garage door manufacturer, the garage door model/series number, the positive and negative design wind pressure rating, the installation instruction drawing reference number, and the applicable test standard.
R703.2 Water-resistive barrier.
One layer of No. 15 asphalt felt, free from holes and breaks, complying with ASTM D226 for Type 1 felt or other approved water-resistive barrier shall be applied over studs or sheathing of all exterior walls. No.15 asphalt felt shall be applied horizontally, with the upper layer lapped over the lower layer not less than 2 inches (51 mm). Where joints occur, felt shall be lapped not less than 6 inches (152 mm). Other approved materials shall be installed in accordance with the water-resistive barrier manufacturer's installation instructions. The No. 15 asphalt felt or other approved water-resistive barrier material shall be continuous to the top of walls and terminated at penetrations and building appendages in a manner to meet the requirements of the exterior wall envelope as described in Section R703.1.
R802.1.5.4 Labeling.
In addition to the labels required by Section 802.1.1 for sawn lumber and Section 803.2.1 for wood structural panels, each piece of fire-retardant-treated lumber and wood structural panel shall be labeled. The label shall contain:
- The identification mark of an approved agency in accordance with Section 1703.5 of the International Building Code.
- Identification of the treating manufacturer.
- The name of the fire-retardant treatment.
- The species of wood treated.
- Flame spread index and smoke-developed index.
- Method of drying after treatment.
- Conformance to applicable standards in accordance with Sections R802.1.5.5 through R802.1.5.10.
- For FRTW exposed to weather, or a damp or wet location, the words “No increase in the listed classification when subjected to the Standard Rain Test” (ASTM D2898).
R1005.8 Insulation shield.
Where factory-built chimneys pass through insulated assemblies, an insulation shield constructed of steel having a thickness of not less than 0.0187 inch (0.4712 mm) (No. 26 gage) shall be installed to provide clearance between the chimney and the insulation material. The clearance shall be not less than the clearance to combustibles specified by the chimney manufacturer's installation instructions. Where chimneys pass through attic space, the shield shall terminate not less than 2 inches (51 mm) above the insulation materials and shall be secured in place to prevent displacement. Insulation shields provided as part of a listed chimney system shall be installed in accordance with the manufacturer's installation instructions.
N1101.13 (R401.2) Compliance.
Projects shall comply with all provisions of Chapter 11 labeled “Mandatory” and one of the following:
- Sections N1101.14 through N1104.
- Section N1105.
- Section N1106.
- The most recent version of REScheck keyed to the 2018 IECC.

The building or dwelling unit shall be tested and verified as having an air leakage rate not exceeding five air changes per hour in Climate Zone 4. Testing shall be conducted in accordance with RESNET/ICC 380, ASTM E779, or ASTM E1827 and reported at a pressure of 0.2 inches w.g. (50 Pa). A written report of the results of the test shall be signed by the party conducting the test and provided to the building official. Testing shall be conducted by a Virginia licensed general contractor, a Virginia licensed HVAC contractor, a Virginia licensed home inspector, a Virginia registered design professional, a certified BPI Envelope Professional, a certified HERS rater, or a certified duct and envelope tightness rater. The party conducting the test shall have been trained on the equipment used to perform the test. Testing shall be performed at any time after creation of all penetrations of the building thermal envelope.
Note: Should additional sealing be required as a result of the test, consideration may be given to the issuance of temporary certificate of occupancy in accordance with Section 116.1.1.

- Exterior windows and doors and fireplace and stove doors shall be closed, but not sealed beyond the intended weatherstripping or other infiltration control measures;
- Dampers, including exhaust, intake, makeup air, backdraft, and flue dampers shall be closed, but not sealed beyond intended infiltration control measures;
- Interior doors, if installed at the time of the test, shall be open;
- Exterior doors for continuous ventilation systems and heat recovery ventilators shall be closed and sealed;
- Heating and cooling systems, if installed at the time of the test, shall be turned off; and
- Supply and return registers, if installed at the time of the test, shall be fully open.
N1104.1 (R404.1) Lighting equipment (Mandatory).
Not less than 90 percent of the permanently installed lighting fixtures shall contain only high-efficacy lamps.
M1502.3.1 Exhaust termination outlet and passageway size.
The passageway of dryer exhaust duct terminals shall be undiminished in size and shall provide an open area of not less than 12.5 square inches (8065 mm2).
M1502.4.2 Duct installation.
Exhaust ducts shall be supported at 4-foot (1219 mm) intervals and shall be secured in place. The insert end of the duct shall extend into the adjoining duct or fitting in the direction of airflow. Ducts shall not be joined with screws or similar fasteners that protrude into the inside of the duct. Where dryer exhaust ducts are enclosed in wall or ceiling cavities, such cavities shall allow the installation of the duct without deformation.
E3405.3 Indoor dedicated panelboard space.
The indoor space equal to the width and depth of the panelboard and extending from the floor to a height of 6 feet (1829 mm) above the panelboard, or to the structural ceiling, whichever is lower, shall be dedicated to the electrical installation. Piping, ducts, leak protection apparatus and other equipment foreign to the electrical installation shall not be installed in such dedicated space. The area above the dedicated space shall be permitted to contain foreign systems, provided that protection is installed to avoid damage to the electrical equipment from condensation, leaks and breaks in such foreign systems (see Figure E3405.1).
Exception: Suspended ceilings with removable panels shall be permitted within the 6-foot (1829 mm) dedicated space.
E3405.4 Outdoor dedicated panelboard space.
The outdoor space equal to the width and depth of the panelboard, and extending from grade to a height of 6 feet (1829 mm) above the panelboard, shall be dedicated to the electrical installation. Piping and other equipment foreign to the electrical installation shall not be located in this zone.
E3406.12 Installation.
Where a tightening torque is indicated as a numeric value on equipment or in installation instructions provided by the manufacturer, a calibrated torque tool shall be used to achieve the indicated torque value, except where the equipment manufacturer has provided installation instructions for an alternative method of achieving the required torque. [110.14 (D)]
E3611.5 Rebar type concrete-encased electrode.
Where a grounding electrode conductor or bonding jumper is connected to a rebar extended from the location of a rebar-type concrete-encased electrode installed in accordance with Section E3608.1.2, the point of connection to the rebar extension shall be in an accessible location that is not subject to corrosion of the rebar. The rebar extension shall not be exposed to contact with the earth without corrosion protection. [250.68 (C) (3)]
E3703.5 Garage branch circuits.
In addition to the number of branch circuits required by other parts of this section, not less than one 120-volt, 20-ampere branch circuit shall be installed to supply receptacle outlets in attached garages and in detached garages with electric power. This circuit shall not have other outlets.
Exception: This circuit shall be permitted to supply readily accessible outdoor receptacle outlets.
E3802.4 In unfinished basements.
Where Type SE or NM cable is run at angles with joists in unfinished basements, cable assemblies containing two or more conductors of sizes 6 AWG and larger and assemblies containing three or more conductors of sizes 8 AWG and larger shall not require additional protection where attached directly to the bottom of the joists. Smaller cables shall be run either through bored holes in joists or on running boards. Type NM or SE cable installed on the wall of an unfinished basement shall be permitted to be installed in a listed conduit or tubing or shall be protected in accordance with Table E3802.1. Conduit or tubing shall be provided with a suitable insulating bushing or adapter at the point where the cable enters the raceway. The sheath of the Type NM or SE cable shall extend through the conduit or tubing and into the outlet or device box not less than ¼ inch (6.4 mm). The cable shall be secured within 12 inches (305 mm) of the point where the cable enters the conduit or tubing. Metal conduit, tubing, and metal outlet boxes shall be connected to an equipment grounding conductor complying with Section E3908.13.
E3901.4.3 Peninsular countertop space.
Not less than one receptacle outlet shall be installed at each peninsular countertop long dimension space having a long dimension of 24 inches (610 mm) or greater and a short dimension of 12 inches (305 mm) or greater. A peninsular countertop is measured from the connected perpendicular wall. [210.52(C)(3)]
E3901.9 Basements, garages and accessory buildings.
Not less than one receptacle outlet, in addition to any provided for specific equipment, shall be installed in each separate unfinished portion of a basement; in each vehicle bay not more than 5.5 feet (1676 mm) above the floor in attached garages; in each vehicle bay not more than 5.5 feet (1676 mm) above the floor in detached garages that are provided with electric power and in accessory buildings that are provided with electric power. [210.52(G)(1), (2), and (3)]
E3902.4 Crawl space receptacles and lighting outlets.
Where a crawl space is at or below grade level, 125-volt, single-phase, 15- and 20-ampere receptacles installed in such spaces shall have ground-fault circuit-interrupter protection for personnel. Lighting outlets not exceeding 120 volts shall have ground-fault circuit-interrupter protection. [210.8(A)(4), 2108(E)]
E3902.16 Arc-fault circuit-interrupter protection.
Branch circuits that supply 120-volt, single phase, 15-ampere and 20-ampere outlets installed in kitchens, family rooms, dining rooms, living rooms, parlors, libraries dens, bedrooms, sunrooms, recreation rooms, closets, hallways, laundry areas and similar rooms or areas shall be protected by any of the following:
- A listed combination-type arc-fault circuit interrupter installed to provide protection of the entire branch circuit.
- A listed branch/feeder-type AFCI installed at the origin of the branch-circuit in combination with a listed outlet branch-circuit type arc-fault circuit interrupter installed at the first outlet box on the branch circuit. The first outlet box in the branch circuit shall be marked to indicate that it is the first outlet of the circuit.
- A listed supplemental arc protection circuit breaker installed at the origin of the branch circuit in combination with a listed outlet branch-circuit type arc-fault circuit interrupter installed at the first outlet box on the branch circuit where all of the following conditions are met:
3.1.The branch-circuit wiring shall be continuous from the branch-circuit overcurrent device to the outlet branch-circuit arc-fault circuit interrupter.
3.2.The maximum length of the branch-circuit wiring from the branch-circuit overcurrent device to the first outlet shall not exceed 50 feet (15.2 m) for 14 AWG conductors and 70 feet (21.3 m) for 12 AWG conductors.
3.3.The first outlet box on the branch circuit shall be marked to indicate that it is the first outlet on the circuit. - A listed outlet branch-circuit type arc-fault circuit interrupter installed at the first outlet on the branch circuit in combination with a listed branch-circuit overcurrent protective device where all of the following conditions are met:
4.1.The branch-circuit wiring shall be continuous from the branch-circuit overcurrent device to the outlet branch-circuit arc-fault circuit interrupter.
4.2.The maximum length of the branch-circuit wiring from the branch-circuit overcurrent device to the first outlet shall not exceed 50 feet (15.2 m) for 14 AWG conductors and 70 feet (21.3 m) for 12 AWG conductors.
4.3.The first outlet box on the branch circuit shall be marked to indicate that it is the first outlet on the circuit.
4.4.The combination of the branch-circuit overcurrent device and outlet branch-circuit AFCI shall be identified as meeting the requirements for a system combination-type AFCI and shall be listed as such. - Where metal outlet boxes and junction boxes and RMC, IMC, EMT, Type MC or steel-armored Type AC cables meeting the requirements of Section E3908.8, metal wireways or metal auxiliary gutters are installed for the portion of the branch circuit between the branch-circuit overcurrent device and the first outlet, a listed branch-circuit type AFCI installed at the first outlet shall be considered as providing protection for the remaining portion of the branch circuit.
- Where a listed metal or nonmetallic conduit or tubing or Type MC cable is encased in not less than 2 inches (50.8 mm) of concrete for the portion of the branch circuit between the branch-circuit overcurrent device and the first outlet, a listed outlet branch-circuit type AFCI installed at the first outlet shall be considered as providing protection for the remaining portion of the branch circuit.
Exceptions:
- AFCI protection is not required for an individual branch circuit supplying only a fire alarm system where the branch circuit is wired with metal outlet and junction boxes and RMC, IMC, EMT or steel-sheathed armored cable Type AC, or Type MC meeting the requirements of Section E3908.8.
- AFCI protection is not required where GFCI protection is required in accordance with E3902 and NEC 210.8(A).
E4205.5 Pool motors.
Wiring methods installed in the corrosive environment described in Section E4202.2.1 shall comply with Section E4202.2.2 or shall be Type MC cable listed for that location. Wiring methods installed in corrosive environments described in Section E4202.2.1 shall contain an insulated copper equipment conductor sized in accordance with Table E3908.12 but not smaller than 12 AWG.
Where installed in noncorrosive environments, branch circuit wiring methods shall comply with Chapter 38. [680.21(A)(1)].
E4205.6 Feeders.
These provisions shall apply to any feeder on the supply side of panelboards supplying branch circuits for pool equipment covered in this chapter and on the load side of the service equipment. Where feeders are installed in corrosive environments as described in Section E4202.2, the wiring method of that portion of the feeder shall comply with Section E4202.2.1 or shall be liquid-tight flexible nonmetallic conduit (LFNMC). Wiring methods installed in corrosive environments as described in Section E4202.2.1 shall contain an insulated copper equipment grounding conductor sized in accordance with Table E3908.12, but not smaller than 12 AWG.
Where installed in noncorrosive environments, feeder wiring methods shall comply with Chapter 38. [680.25(A)].
E4205.9 Grounding and bonding terminals.
Grounding and bonding terminals shall be identified for use in wet and corrosive environments. Field-installed grounding and bonding connections in a damp, wet or corrosive environment shall be composed of copper, copper alloy or stainless steel and shall be listed for direct burial use. (680.7)

The Commonwealth’s Attorney’s Office is involved in all felony charges in Juvenile and Domestic Relations Court, General District Court, or Circuit Court, as well as all misdemeanors that are appealed to the Circuit Court. In Juvenile and Domestic Relations District Court, the Commonwealth’s Attorney’s Office prosecutes all charges against juveniles except possession of tobacco and traffic matters. These are prosecuted by the law enforcement agent who took out the charge.
For adult defendants in Juvenile and Domestic Relations Court, the Commonwealth Attorney’s Office is involved in domestic assaults, drug-related charges, firearm-related charges, and all felonies.
In General District Court, the Commonwealth’s Attorney’s Office prosecutes all felonies, but a more limited numbers of misdemeanors. As a rule, the office prosecutes DUIs, drug, weapon, sexual battery, and stalking misdemeanor charges. The Commonwealth may become involved in other misdemeanors at their discretion, or upon victim/witness request.

A prosecutor will normally be assigned to a case after an investigative report is received from the York County Sheriff’s Office, Poquoson Police Department, or Virginia State Police and the defendant has appeared in court for arraignment. This may take several days.Commonwealth Attorney
Due to caseload, the prosecutor on any given case may not contact victims or witnesses in a case until 2 to 3 days before the court date. What this means is that once charges are filed and the Commonwealth’s Attorney’s Office decides to proceed with the case, you can no longer withdraw the charges. When competitive negotiation is the method of procurement, price is not the sole determining factor. The RFP document identifies the criteria that will be used in making the award decision. An evaluation panel of County staff review and evaluate each proposal against the evaluation criteria. Vendor presentations and discussions may be conducted, along with negotiations. The RFP describes the details of the evaluation process.
There is a special process when the solicitation is for "Professional Services". The state procurement code says: "Professional services" means work performed by an independent contractor within the scope of the practice of accounting, actuarial services, architecture, land surveying, landscape architecture, law, dentistry, medicine, optometry, pharmacy or professional engineering. Per a mandatory provision in the state procurement code, the price of the professional services is not part of the initial evaluation, and is only addressed during negotiations.

For purchases up to $2,500, Departments within the County may make purchases directly using a "P-Card", which is a VISA credit card.
For purchases up to $5,000, Departments may make a purchase without a Purchase Order. The vendor must direct invoice the purchaser, and the County will issue the vendor a check. This method is discouraged.
Purchase Orders may be used for making purchases of any amount. Only one quote is required when the purchase amount is less than $5,000. If the purchase amount is between $5,000 and $25,000, then three quotes are obtained by the County (may be requested by phone, fax, or email). For purchases over $25,000, the Central Purchasing Office must obtain the quotes. Purchase Orders are issued by the Purchasing office.

Non-County residents will be assessed normal deductibles and co-pays in addition to the amount the insurance companies approve for payment. Uninsured or under-insured patients who demonstrate financial hardship will be eligible for a hardship waiver, sliding scale deductibles, or a payment plan that may require moderate payments with no interest or penalties.

There are several reasons why a fire engine may respond to a medical call. It is important to remember that firefighters in York County are cross-trained in emergency medical care.
Serious medical situations may require the application of multiple procedures. The additional assistance provided by department members from the fire engine often contributes to the patient care and treatment process as well as reduces the time it takes the patient to reach the hospital. The County of York offers direct deposits to all of our vendors for their check payments. Like checks, these payments are entered into the computer on Thursdays and instead of having a check printed, the payment is automatically deposited into your bank account on the morning of the Tuesday pay date. This saves time on the mail service delivering your check to you, and time that you would spend on going to the bank to deposit the check. This also defrays the possibility of a check being mailed to the incorrect address or being lost in the mail. Once an invoice is received, it is sent to the specific department for approval and payment authorization. Once the payment is authorized, the invoice is entered into the computer system for a check to be printed. All County AP check batches are entered on Thursdays and the check payments are printed on the following Tuesday. If there is a holiday on the Monday before a check is printed, the check may be delayed by one day. Also, if there is a discrepancy with the invoice or corresponding paperwork, the check may be delayed. A 1099 form is a statement given to vendors showing them how much the County paid them for services that they provided to the County, during the previous calendar year. By law, if you received more than $600 in compensation from the County, for any service that you provided to the County, and your company is not incorporated, you will receive a 1099 tax form. There are several exceptions which include law firms and medical institutions which receive 1099s even if they are incorporated. The County must report all payments made to 1099-vendors, to the Federal government (IRS), every year. We must also, by law, provide a copy of this 1099 statement to the actual vendor. The civil jurisdiction for claims in the General District Court is $25,000. You may obtain a civil warrant from the General District Court Clerk’s office during our business hours which are 8:00 a.m. to 4:00 p.m., Monday through Friday, except State holidays. Filing fee of a civil warrant is $50. An additional fee of $12 per defendant is required for service by the Sheriff. No additional fee is required for service by a private process server.

The Small Claims division has jurisdiction over claims in which the plaintiff is seeking a money judgment up to $5,000 or recovery of personal property valued up to that amount. Small Claims cases are heard on the third Mondays each month at 1:00 p.m. The cost for a Warrant In Debt - Small Claims Division is the same as for all other civil warrants. All parties should appear in Court prepared for trial. Contested claims are heard on the first return date and are not rescheduled.

The building permits section needs to see a scaled drawing of your property lines and any existing structures to ensure that your new construction will fall inside the building setback regulations. The best document for this application is a property survey, done by a licensed surveyor, as it is the most accurate. If you don't have one of those, we can produce a drawing for you showing the property lines and the man-made features, but it is not nearly as accurate as a real survey, and therefore may not be suitable for all applications. We will produce and print this drawing for you in our office during normal business hours.

Yes. The GIS office, located in the Planning Building (100 County Drive)), will provide small format (letter or ledger sized) GIS maps and survey plats for free under 5 copies. Additional copies are $1 per simple small maps and a few dollars more for “heavy” ink usage maps.
The charge for large format maps are based on overall size and use of ink. Maps larger than 36”x36” are $10 or $15; low ink vs. heavy ink. Maps larger than 36”x36” are $12 or $20; low ink vs. heavy ink.
"Heavy ink” maps are any aerial imagery maps or layers that cover the entire map in solid colors, such as Zoning, or Election Districts maps.

If you are thinking about renting out your house, an accessory structure, or one or more rooms in your house on a short-term basis (i.e., fewer than 90 days), here are some things you need to know:
- In York County, short-term rentals (STRs) fall into the category of either tourist homes or bed and breakfast inns (B&Bs). The distinction between the two is that in a B&B, breakfast is provided in addition to overnight accommodations.
- Tourist homes and B&Bs are permitted as a matter of right in the LB (Limited Business) and GB (General Business) zoning districts. In residential zoning districts – RC, RR, R33, R20, R13, and RMF – they are permitted only upon the issuance of a Special Use Permit by the Board of Supervisors. Use the York County Property Information System to determine the zoning designation for a specific address.
- Special Use Permits are a special privilege granted by the Board of Supervisors under a specific set of circumstances and conditions, and each application and situation is unique. The Special Use Permit process typically takes between two and three months. It requires two advertised public hearings, and a non-refundable application fee of $560 in most cases. - The Board of Supervisors adopted Board Policy No. BP24-30 on June 18, 2024. In addition to the requirements of Section 24.1-409 of Zoning Ordinance, the Board Policy provides additional guidance for applicants and decision-makers considering Special Use Permit applications for new short-term rentals. The guidelines address residency, location, limits of operation, use permit expiration, etc. Click here to view the policy.
- STRs in residential districts must have the appearance of a single-family detached home and normal accessory residential structures.
- All parking must be accommodated on the property. On-street parking is prohibited.
- The maximum number of guests will be determined by the Board of Supervisors based on the density and character of the area and the size and characteristics of the proposed site.
- STRs are subject to the state sales tax as well as the 5% County transient occupancy tax and $2.00 per night room tax. The proprietor of any such establishment is required to obtain a County business license, establish a County transient occupancy tax account, and file with the Virginia Department of Taxation for a Virginia State Sales Tax account. What can and cannot be built on a piece of property depends on how it is zoned. For every zoning district in the County, there are certain uses that are allowed as a matter of right, other uses that are allowed only with the approval of a Special Use Permit by the Board of Supervisors, and some uses that are not allowed. All rezoning and Special Use Permit applications are referred to the Planning Commission. Zoning stems largely from the Comprehensive Plan. The Comprehensive Plan is the long-range plan for the physical development of the County. It sets forth the County's future plans for land use, transportation, community facilities, the environment, housing, economic development, and historic resources. Accessory apartments are permitted as a matter of right in all single-family residential zoning districts as long as the floor area of the apartment does not exceed 1,000 square feet or 35% of the floor area of the principal dwelling - or 49% upon authorization by Special Use Permit - whichever is less. In no case can the lot coverage (i.e., building footprint) of a detached accessory apartment exceed 75% of the lot coverage of the principal structure.

As a general rule, home occupations that do not have customer or client contact on the premises are permitted by right . Home occupations that involve on-premises customer or client contact usually require a Special Use Permit from the Board of Supervisors. There are exceptions - including photography studios, day care for up to 4 children, and tutoring or music lessons for up to 4 persons - all of which are permitted as a matter of right in the RC, RR, R33, R20, and R13 zoning districts.
Other home occupations that require a Special Use Permit include those that have non-resident employees or generate a parking demand for at least 3 parking spaces. Small contracting businesses in the RC, RR, or WCI zoning district also require a Special Use Permit. Prohibited home occupations include auto repair and servicing, funeral homes, gift shops, medical or dental clinics and restaurants. That depends on where the ditch is located.
Roadside ditches are maintained by VDOT. If it is along the road, it is in the VDOT right-of-way (ROW) and it is their responsibility to maintain and repair.

You can also submit a service request online at https://my.vdot.virginia.gov/, or call the central service center at 1-800-FOR-ROAD (367-7623).
If the ditch is not along the roadway, or if it is outside the VDOT ROW, then the county would maintain it (if it is in an easement dedicated to York County). If it is off the roadway and in a county easement, please call Department of Public Works at 757-890-3750 and we will have the stormwater engineers investigate the issue. You can also put in a service request on our website here.
Some easements are dedicated to Homeowners Associations (HOA’s) and would be their responsibility to fix.
To find out who owns or maintains the ditches and pipes, you should start by looking at the plat for your property or subdivision. If you don’t have a copy of this, you can find it on the county website by going to property information and looking up the address. Once you are on the property in question, go to the map and under "Tools" on the upper right side, click on "Identify". Then go to the left side under "Layers" at the pop down box click on "Plat" link. Go back to the parcel in question and click on it again. Click the "More Information" link and you should be able to see the subdivision plat.
If that doesn’t work or you’re still not sure, go to the Customer Service Request Portal and put in your service request. You will be provided a work order request number.

York County Ordinance requires “Each septic tank and/or pumping chamber should be inspected and if necessary, pumped out and the solids removed at least once every five (5) years.” Receipts must be sent to Department of Public Works for recording. Homeowners with septic tanks are encouraged to create an inspection schedule to determine if more frequent inspection/pump out is necessary.

On the County’s website go to Property Information Lookup and type in your street name. It will list the flood zones on the information for your property and the different elevations for the AE Zone. If you go to maps and then view Interactive Map it will show your property. On the left column check Buildings and Flood Zone (under Environmental) and it will show the flood zone with relation to your house.

Make sure there is nothing in or near ditches or pipes that can block drainage. To help yourself and your neighbors, keep your ditches clean of leaves and other debris. If a big storm is coming, check to make sure nothing is blocking drainage. Loose items can wash into drainage ways so make sure items are put away.

Unlike sewer, stormwater does not go to a treatment plant. Some stormwater goes to a pond or other system that will remove some of the pollutants, like fertilizer, before it goes downstream to a creek and then the Bay. Older developments (prior to 1985) usually go directly to the creeks.

An illicit discharge is anything other than stormwater. Pollutants that are intentionally dumped into stormwater are considered illicit and the polluter can be sited for a violation of the County Stormwater Ordinance if they are caught discharging in to the County Stormwater System.

- Landscape irrigation
- Diverted stream flows or rising groundwater
- Infiltration of uncontaminated groundwater
- Public safety activities
- Pumping of uncontaminated groundwater from potable water sources, or foundation drains, irrigation waters, springs or water from crawl spaces or footing drains
- Air conditioning condensation
- Lawn watering
- Individual residential car washing
- Flows from riparian habitats or wetlands
- Dechlorinated swimming pool discharges

All public records are presumed to be open, and may only be withheld if a specific statutory exemption applies.
The policy of FOIA states that the purpose of FOIA is to promote an increased awareness by all persons of governmental activities. In furthering this policy, FOIA requires that the law be interpreted liberally, in favor of access, and that any exemption allowing public records to be withheld must be interpreted narrowly.

Freedom of Information Act
The Code of Virginia allows any public body to withhold certain records from public disclosure. York County commonly withholds records subject to the following exemptions:
- Personnel records - Va. Code § 2.2-3705.1 (1)
- Records subject to attorney-client privilege - Va. Code § 2.2-3705.1 (2) or attorney work product Va. Code § 2.2-3705.1 (3)
- Vendor proprietary information - Va. Code § 2.2-3705.1 (6)
- Records relating to the negotiation and award of a contract, prior to a contract being awarded - Va. Code § 2.2-3705.1 (12)
- Working papers and correspondence of the County Administrator - Va. Code § 2.2-3705.7 (2)

The general policy of York County is to:
- invoke the personnel records exemption in those instances where it applies in order to protect the privacy of employees and officials of York County.
- invoke the contract negotiations exemption whenever it applies in order to protect York County's bargaining position and negotiating strategy.
- invoke the attorney-client privilege and work product exemptions whenever they apply, to protect the confidentiality of legal advice and to preserve York County's litigation strategy.
The general policy of York County is for County officials to exercise their discretion in a reasonable manner when an exemption applies, weighting the public interest in inspecting the record, and the public interest in maintaining the confidentiality of the record.
The general policy of York County is to release any records when the reason or legal basis for withholding them no longer applies.

Freedom of Information Act
York County must respond to your request within five working days of receiving it. "Day One" is considered the day after your request is received. The five-day period does not include weekends or holidays.
The reason behind your request for public records from York County is irrelevant, and you do not have to state why you want the records before we respond to your request. FOIA does, however, allow York County to require you to provide your name and legal address.
FOIA requires that York County make one of the following responses to your request within the five-day time period:
- We provide you with the records that you have requested in their entirety.
- We withhold all of the records that you have requested, because all of the records are subject to a specific statutory exemption. If all of the records are being withheld, we must send you a response in writing. That writing must identify the volume and subject matter of the records being withheld, and state the specific section of the Code of Virginia that allows us to withhold the records.
- We provide some of the records that you have requested, but withhold other records. We cannot withhold an entire record if only a portion of it is subject to an exemption. In that instance, we may redact the portion of the record that may be withheld, and must provide you with the remainder of the record. We must provide you with a written response stating the specific section of the Code of Virginia that allows portions of the requested records to be withheld.
- We inform you in writing that the requested records cannot be found or do not exist (we do not have the records you want). However, if we know that another public body has the requested records, we must include contact information for the other public body in our response to you.
- If it is practically impossible for York County to respond to your request within the five-day period, we must state this in writing, explaining the conditions that make the response impossible. This will allow us seven additional working days to respond to your request, giving us a total of 12 working days to respond to your request.
- If you make a request for a very large number of records, and we feel that we cannot provide the records to you within 12 working days without disrupting our other organizational responsibilities, we may petition the court for additional time to respond to your request. However, FOIA requires that we make a reasonable effort to reach an agreement with you concerning the production or the records before we go to court to ask for more time.

- A public body may make reasonable charges not to exceed its actual cost incurred in accessing, duplicating, supplying, or searching for the requested records. No public body shall impose any extraneous, intermediary, or surplus fees or expenses to recoup the general costs associated with creating or maintaining records or transacting the general business of the public body. Any duplicating fee charged by a public body shall not exceed the actual cost of duplication. All charges for the supplying of requested records shall be estimated in advance at the request of the citizen as set forth in subsection F of § 2.2-3704 of the Code of Virginia.
- You may have to pay for the records that you request from York County. FOIA allows us to charge for the actual costs of responding to FOIA requests. This would include items like staff time spent searching for the requested records, copying costs or any other costs directly related to supplying the requested records. It cannot include general overhead costs.
- If we estimate that it will cost more than $200 to respond to your request, we may require you to pay a deposit, not to exceed the amount of the estimate, before proceeding with your request. The five days that we have to respond to your request does not include the time between when we ask for a deposit and when you respond.
- Effective July 1, 2022 - Per Code of VA 2.2-3704 (F), public bodies are required to inform requesters that the public body may make reasonable charges not to exceed the actual cost incurred in accessing, duplicating, supplying or searching for requested records, and shall ask the requester whether they wish to receive a cost estimate in advance of supplying the requested records. A cost estimate shall be provided if requested. If, after receiving the cost estimate, the requester would like the County to proceed with the records request, the staff time required to determine the cost estimate will be applied to the final amount due. If the requester does not respond to the County’s question within 30 days, the request will be deemed withdrawn. This provision allows you to know about any costs up front, or gives you the opportunity to modify your request in an attempt to lower the estimated costs.
- If you owe us money from a previous FOIA request that has remained unpaid for more than 30 days, York County may require payment of the past-due bill before it will respond to your new FOIA request.

The extension penalty is applied to the balance of the tax that was due, May 1, through the date the return is filed. The maximum extension penalty is 12%.
- Interest will be charged on the tax due amount, even if you meet the 90% payment requirement for returns with an automatic 6-month extension.
- No application for an extension is required.
- This extension does not extend the time to pay.

For the semi-annual tax bills due in June and December, the county utilizes a PO Box in Maryland with our bank to process the payments. This is due to the large increase in volume that occurs with semi-annual billings. Geographically, this is the closest processing center the county’s bank has for our use. This is a very fast and efficient way to process the 10,000 to 12,000 items sent twice per year to the Maryland address. This process has been in place for several years.
Taxpayers can always mail payments to the office if they do not wish to have the mail routed to Maryland. There are also free online e-check payments using the portal or Quick Pay options.

The U.S. Constitution guarantees people charged with crimes will have the write to 'cross-examine their accusers.' In effect, the defendant or his attorney has the right to ask victims about the reported crime, including questions about what happened, how it happened, when it happened, and other details.
A written statement is only that-a written statement. There is no opportunity for the defendant to question the victim about the case. Therefore, the complaining witness in a case (also known as the victim) will always be needed to appear in court to testify, unless there are special circumstances, such as a plea agreement.

The Commonwealth’s Attorney’s Office for York County and the City of Poquoson has a "no drop" policy on all charges. Because the defendant has broken a law of the Commonwealth of Virginia, the Commonwealth's Attorney's Office must prosecute the crime. What this means is that once charges are filed and the Commonwealth’s Attorney’s Office decides to proceed with the case, you can no longer withdraw the charges. Only the Court has the authority to dismiss, or "drop" charges. If the ditch is not along the roadway, or if it is outside the VDOT ROW, then the county would maintain it (if it is in an easement dedicated to York County). Some easements are dedicated to Homeowners Associations (HOA’s) and would be their responsibility to fix.
To find out who owns or maintains the ditches and pipes, you should start by looking at the plat for your property or subdivision. If you don’t have a copy of this, you can find it on the county website by going to property information and looking up the address. Once you are on the property in question, go to the map and under "Tools" on the upper right side, click on "Identify". Then go to the left side under "Layers" at the pop down box click on "Plat" link. Go back to the parcel in question and click on it again. Click the "More Information" link and you should be able to see the subdivision plat.
If that doesn’t work or you’re still not sure, go to the Customer Service Request Portal and put in your service request. You will be provided a work order request number.

Virginia state statutes do not set a specific age after which a child legally can stay alone. Age alone is not a very good indicator of a child's maturity level. Some very mature 10 year olds may be ready for self care while some 15 year olds may not be ready due to emotional problems or behavioral difficulties. In determining whether a child is capable of being left alone and whether a parent is providing adequate supervision in latchkey situations, Child Protective Services (CPS) will assess several areas.
These areas include:
Child's level of maturity. CPS will want to assess whether the child is physically capable of taking care of himself, is mentally capable of recognizing and avoiding danger and making sound decisions; is emotionally ready to be alone; knows what to do and whom to call if an emergency arises; and has special physical, emotional, or behavioral problems that make it unwise to be left alone. Its important to note that a child who can take care of him/herself may not be ready to care for younger children.
Accessibility of those responsible for the child. CPS will want to determine the location and proximity of the parents, whether they can be reached by phone and can get home quickly if needed, and whether the child knows the parents location and how to reach them.
The situation. CPS will want to assess the time of day and length of time the children will be left alone; the safety of the home or neighborhood; whether the parents have arranged for nearby adults to be available in case a problem arises; and whether there is a family history of child abuse or neglect.
Some localities have ordinance concerning the age at which a child may be left without supervision.

If you are a legal Virginia resident but are not yet registered to vote, or need to change your voter registration, you may use the Federal Post Card Application (FPCA) to register to vote and apply for your absentee ballot at the same time. After you complete the FPCA, sign it and then you may either mail it to your local voter registration office, e-mail or fax it to your local voter registration office. You should complete this application (FPCA) before you complete any other forms or applications relating to voter registration and/or absentee voting. You may also register and request absentee ballots using the Virginia voter registration application and absentee ballot application linked on this page. There are a variety of reasons that could be the cause of non-collection. Here are the most common:
- Too close to another item for automated truck to collect (must be three feet away from any other item)
- Must be out by 7 a.m. on your collection day (late set out)
- Overloaded (more than 260 pounds in weight)
- Overstuffed (lid not closed and trash would spill when lifted)
- Opening of the trash container not facing the street
- Have more containers than you are paying for (other containers not collected)
- See tag left on container for other reasons

Our trash contractor observes at least the following holidays: New Year's Day, Fourth of July, Thanksgiving Day, and Christmas Day. Collections that fall on these holidays will be delayed by one day and each collection day that follows the holiday will be delayed by one day (for example, if the holiday is on a Tuesday, Tuesday's collections will be on Wednesday, Wednesday's will be on Thursday, etc.). All other holidays will have regular collection.

You may put bagged leaves or grass clippings in your container for pickup. Please make sure that you do not overload your container when doing so as the truck cannot lift the container if it weighs more than 260 pounds or if the lid is not closed on the container.

- If the paint is old and dry, you can leave the lid off and dispose of in your regular trash.
- If the paint is still a liquid, you can add kitty litter or other absorbent material such as sawdust or mulch, and stir it well until it becomes very thick and will not drip or run. Once you’ve done this, you can leave the lid off and dispose of it in your regular trash. Please note: this ONLY APPLIES to latex (water based) paint.

VPPSA holds a total of 13 household chemical collection events per year and accepts a variety of paints, fuels, solvents, pesticides, automotive products and other chemicals from residents of Hampton, Poquoson, Williamsburg, James City County and York County. Many computer-related items accepted for recycling at these events as well.
Computer Recycling
- Since 2001, our contractor, Computer Recycling of Virginia, has erased every hard drive using software that meets or exceeds all industry standards, including the NIST 800-88. Once the wipe process is complete, any hard drive that fails the wipe process is physically destroyed.
- The mission of Computer Recycling of Virginia, Inc. (CRVA) is to place educationally–useful equipment into Virginia’s schools and non-profit organizations free of charge, while promoting electronics recycling throughout Virginia.

If you need more propane, you can have the tank refilled or exchanged at a local retailer. A propane tank exchange is less expensive than buying a new one.
It is also possible to recycle your empty propane tank. Some retailers will accept unused or partially used propane tanks and will recycle them.
If you are unable to take it to a retail location, Waste Management Division will accept completely empty propane tanks at the metal recycling area.

If you are scheduling a bulk item pickup at your home, you may include a mattress/box spring as one of your bulk items. If you subscribe to the County's curbside garbage service, you can bring it to the Waste Management Center, 145 Goodwin Neck Road, for disposal. Contractors, residents from other localities and County residents who do not subscribe to the County’s curbside collection program will be charged $33.00 per mattress/$33.00 per box spring.
